TERMS OF SERVICE

End User License Agreement · Last updated April 20, 2026

These Terms of Service and End User License Agreement (the "Terms") form a binding agreement between you and PixelForge Entertainment, LLC ("Pixel Forge Arcade," "we," "us," or "our"). They govern your access to and use of Gridhammer (the "Game"), the pixelforgearcade.com website, and all related services, software, and features we operate (collectively, the "Service").

By downloading, installing, accessing, or playing the Game, or by creating an account on the Service, you agree to these Terms. If you do not agree, do not use the Service. These Terms should be read together with our Privacy Policy, which is incorporated by reference.

SUMMARY OF KEY POINTS

This summary is for quick reading. The full Terms below control in case of any conflict.

  • You are licensing the Game from us, not buying ownership of it.
  • We own the Game and its content. You may play it and share gameplay videos, but you may not resell, modify, or reverse-engineer it.
  • You agree to play fairly — no cheating, no harassment, no exploits, no commercial exploitation of in-game content.
  • In-game items and currency (Ore Scrips, Slag, Crown Steel, plates, cosmetics) have no real-world value and cannot be transferred or cashed out.
  • We may suspend or terminate accounts that violate these Terms.
  • Purchases and refunds are handled by the platform you bought through (Steam or Epic). We do not process refunds directly.
  • Any disputes are governed by Texas law and resolved in Texas courts.

1. ACCEPTANCE OF THESE TERMS

In Short: Using the Service means you accept these Terms and our Privacy Policy.

By downloading, installing, accessing, or using the Game or Service in any way — including by creating an account, launching the Game, or visiting pixelforgearcade.com — you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must stop using the Service and uninstall the Game.

2. ELIGIBILITY

In Short: You must be at least 18, or using the Service with a parent's supervision.

You must be at least 18 years of age, or the equivalent age of majority in your jurisdiction, to create an account or otherwise use the Service independently. If you are between the minimum age required by the platform you use (for example, Steam's minimum of 13) and 18, you may only use the Service with the knowledge and consent of a parent or legal guardian, who is responsible for your conduct.

By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.

3. YOUR ACCOUNT

In Short: You're responsible for your account. Don't share it, don't sell it, don't let someone else use it.

To access certain features (including online multiplayer, matchmaking, and player profiles), you will need to create an account. When you do, you agree to:
  • Provide accurate, current, and complete registration information, and keep it updated.
  • Maintain the confidentiality of your login credentials and be responsible for all activity under your account.
  • Notify us immediately at support@pixelforgearcade.com of any unauthorized use or security breach.
  • Not share, lend, sell, trade, or otherwise transfer your account to anyone else.
  • Not create or maintain more than one active account to circumvent suspensions or bans.
We may refuse to create, suspend, or terminate any account at our discretion, particularly where we believe it has been used in violation of these Terms.

4. LICENSE TO USE THE SERVICE

In Short: We grant you a limited, personal, non-commercial license to play Gridhammer. That's it — no ownership transfer.

Subject to your ongoing compliance with these Terms, PixelForge Entertainment, LLC grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Game and Service for your personal, non-commercial entertainment purposes only.

This license does not transfer any ownership rights in the Game or its content to you. You may not:
  • Copy, modify, distribute, sell, lease, or sublicense any part of the Game or Service.
  • Reverse engineer, decompile, disassemble, or attempt to derive source code from any part of the Game, except to the extent expressly permitted by applicable law notwithstanding this restriction.
  • Remove or alter any copyright, trademark, or other proprietary notices.
  • Use the Game or Service for any commercial purpose, including operating for-profit servers or tournaments, without our prior written permission.

5. CODE OF CONDUCT

In Short: Play fair. Be decent to others. Don't break the game, the servers, or the law.

When using the Service, you agree NOT to:
  • Use cheats, exploits, automation tools, bots, hacks, mods, or any unauthorized third-party software that gives you or anyone else an unfair advantage or interferes with gameplay for others.
  • Intentionally exploit bugs, unintended behavior, or design flaws for advantage instead of reporting them.
  • Harass, threaten, defame, stalk, or abuse other users, including through in-game chat, display names, or user-generated content.
  • Post, transmit, or display content that is unlawful, obscene, hateful, harassing, or that infringes the rights of any other person or entity.
  • Impersonate any person or entity, including Pixel Forge Arcade staff, or misrepresent your affiliation.
  • Sell, trade, purchase, or attempt to sell, trade, or purchase accounts, in-game items, or virtual currency for real-world consideration outside of mechanisms we expressly provide.
  • Interfere with, disrupt, or overload the Service, our servers, or networks connected to the Service.
  • Circumvent, disable, or otherwise interfere with security-related features, rate limits, or access restrictions.
  • Collect or harvest personal information about other users without their consent.
  • Use the Service in any way that violates any applicable law or regulation, or export control laws.
We reserve the right, at our sole discretion, to investigate any suspected violation and take action, including removing content, issuing warnings, suspending accounts, permanently banning accounts, and reporting unlawful activity to law enforcement.

6. USER CONTENT

In Short: You own what you create, but you give us permission to use it to operate the Service.

The Service may allow you to submit content such as chat messages, usernames, custom deck names, screenshots, and community posts (collectively, "User Content"). You retain ownership of your User Content, but by submitting it, you grant PixelForge Entertainment, LLC a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display your User Content in connection with operating, providing, improving, and promoting the Service, on any media now known or later developed.

You represent and warrant that:
  • You own or have the necessary rights to submit the User Content and to grant the license above.
  • Your User Content does not infringe any third-party rights, violate any law, or breach these Terms.
  • Your User Content is not defamatory, obscene, threatening, harassing, or otherwise objectionable.
We do not actively monitor all User Content, but we reserve the right to review, remove, or edit any User Content at our sole discretion, including to comply with legal obligations or enforce these Terms.

7. INTELLECTUAL PROPERTY & CONTENT CREATOR POLICY

In Short: We own Gridhammer. Streamers and video creators are welcome within reasonable limits.

Our Rights

The Game and Service, including all software, code, artwork, 3D models, 2D art, audio, music, sound effects, user interface elements, game design, mechanics, lore, characters, names, logos, trademarks, and text, are the exclusive property of PixelForge Entertainment, LLC or its licensors, and are protected by copyright, trademark, trade dress, and other intellectual property laws of the United States and other countries.

"Gridhammer," "Pixel Forge Arcade," "Pixel Forge Entertainment," and our associated logos and visual marks are trademarks of PixelForge Entertainment, LLC. You may not use these marks without our prior written permission, except as expressly permitted by these Terms or by applicable law (including fair use for reviews and commentary).

Content Creator & Streaming Permission

You are welcome to stream, record, and share video or screenshots of Gridhammer gameplay on platforms such as YouTube, Twitch, TikTok, Kick, and similar services, including for monetized channels, provided that:
  • You do not claim ownership of the Game, its content, or its underlying intellectual property.
  • You do not imply official endorsement, sponsorship, or partnership with Pixel Forge Arcade unless we have entered into a separate written agreement with you.
  • You do not distribute, bundle, or host playable copies of the Game, modified builds, pirated builds, or leaked pre-release assets.
  • Your content complies with the Code of Conduct in Section 5.
We reserve the right to revoke this permission for any specific channel or creator that violates these Terms or engages in conduct harmful to the Game or our community.

8. VIRTUAL ITEMS AND IN-GAME CURRENCY

In Short: In-game items are licensed to you, have no real-world value, and can be adjusted or removed as the game develops.

The Game may include virtual items, currencies, and collectibles, including but not limited to Ore Scrips, Slag, Crown Steel, plates, allotments, cosmetic coatings, and similar items (collectively, "Virtual Items"). You acknowledge and agree that:
  • Virtual Items are licensed, not sold. Acquiring Virtual Items grants you a limited license to use them within the Game only.
  • Virtual Items have no real-world monetary value. They cannot be redeemed for real-world money, goods, or services from Pixel Forge Arcade or anyone else.
  • Virtual Items are non-transferable between accounts unless we expressly provide an in-game mechanic for such transfer.
  • We reserve the right to modify, adjust, re-balance, disable, or remove any Virtual Item at any time as part of ongoing game development, balance, or for legal, technical, or business reasons. This includes during the Early Access period.
  • If your account is terminated, suspended, or becomes inaccessible for any reason, all Virtual Items associated with that account are forfeited without refund, except where refund is required by applicable consumer law.
  • We make no guarantee that the Service, or any specific Virtual Item, will remain available indefinitely.

9. PURCHASES, PAYMENTS & REFUNDS

In Short: Steam and Epic process purchases and handle refunds. Talk to them for refund requests.

The Game, any downloadable content, and any in-app purchases are sold and distributed through third-party platforms including Steam (operated by Valve Corporation) and the Epic Games Store (operated by Epic Games, Inc.). All purchase transactions are processed by the applicable platform and are subject to that platform's terms of service, payment terms, and refund policy.

Pixel Forge Arcade does not process direct payments or issue direct refunds outside of the platform's refund systems. To request a refund, please contact the platform where you made your purchase:

10. UPDATES, CHANGES & SERVICE AVAILABILITY

In Short: The Game evolves. Features may change or go away. Online features need the internet.

Gridhammer is a live service that will be updated over time, particularly during Early Access. We may, at our discretion and without prior notice:
  • Release patches, content updates, and bug fixes.
  • Adjust game balance, economy, Houses, plate abilities, or progression systems.
  • Add, remove, or modify features, game modes, or content.
  • Temporarily or permanently suspend any part of the Service for maintenance or technical reasons.
Online features — including multiplayer matchmaking, account authentication, the store, and the Sigil Archive — require an internet connection and functioning backend services. We do not guarantee that these features will be continuously available or free of interruption. We may eventually discontinue online services for the Game; if we do, we will endeavor to provide reasonable notice where practical.

11. TERMINATION

In Short: We can end your access for breaking the rules. You can end your own use at any time.

We may suspend or terminate your access to the Service, with or without notice, at any time, for any reason, including (without limitation) if we believe you have violated these Terms, engaged in fraudulent or unlawful conduct, or if we are required to do so by law. Upon termination:
  • Your license to use the Game ends immediately.
  • Your account and any Virtual Items associated with it may be deleted or disabled.
  • Sections of these Terms that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will continue to apply.
You may terminate your account at any time by emailing support@pixelforgearcade.com or by using account-deletion options provided in the Game, if available. Termination does not entitle you to a refund except as required by applicable platform refund policy or consumer law.

12. DISCLAIMERS

In Short: The Service is provided as-is. We don't promise it's perfect or will always work.

THE SERVICE AND GAME ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PIXELFORGE ENTERTAINMENT, LLC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you. In such jurisdictions, our warranties are limited to the minimum extent permitted by law.

13. LIMITATION OF LIABILITY

In Short: If something goes wrong, our liability is capped at what you paid for the Game, or $50 — whichever is greater.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL PIXELFORGE ENTERTAINMENT, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR ACCOUNT ACCESS, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID FOR THE GAME IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50.00).

Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

14. INDEMNIFICATION

In Short: If your misuse of the Service gets us sued, you cover the costs.

You agree to indemnify, defend, and hold harmless PixelForge Entertainment, LLC, its officers, directors, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of or access to the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party right, including any intellectual property, privacy, or publicity right.

We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense.

15. GOVERNING LAW & DISPUTE RESOLUTION

In Short: Texas law applies. Disputes go to Texas courts.

These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of those courts. You waive any objection based on improper venue or forum non conveniens.

Before filing any formal claim, you agree to first contact us at support@pixelforgearcade.com to attempt to resolve the matter informally. Both parties will make a good-faith effort to reach a resolution within thirty (30) days.

16. DMCA COPYRIGHT POLICY

In Short: If you believe something on the Service infringes your copyright, send us a DMCA notice.

We respect the intellectual property rights of others and expect our users to do the same. If you believe that material available through the Service infringes a copyright you own or control, please send a written notice to our designated agent at support@pixelforgearcade.com with the following information, as required by 17 U.S.C. § 512(c)(3):
  • A physical or electronic signature of the copyright owner or authorized representative.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the allegedly infringing material and sufficient information for us to locate it.
  • Your contact information (address, telephone, email).
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act on the owner's behalf.
We will respond to valid notices in accordance with the DMCA, which may include removing or disabling access to the allegedly infringing material and terminating accounts of repeat infringers where appropriate.

17. CHANGES TO THESE TERMS

In Short: We may update these Terms. If we do, we'll let you know.

We may update these Terms from time to time. If we make material changes, we will notify you by updating the "Last updated" date at the top and, where appropriate, by posting a notice in the Game, on our website, or via email. Your continued use of the Service after the updated Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to the updates, you must stop using the Service.

18. MISCELLANEOUS

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and PixelForge Entertainment, LLC regarding the Service and supersede any prior agreements or understandings.

Severability. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

No Waiver. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.

Assignment. You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms to any successor in connection with a merger, acquisition, sale of assets, or similar transaction.

Export Compliance. You may not use or access the Service in any jurisdiction or manner that would violate United States export control laws, sanctions, or regulations, including by providing the Service to persons located in embargoed territories.

Relationship. Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and us.
